These terms apply to every Florage Farms order, delivery, and account interaction.
1. Acceptance Of Terms
By accessing this website, purchasing product, or accepting delivery of goods, you agree to be bound by these Terms of Service and all applicable laws. These terms govern all transactions, whether conducted via the online store, manual invoice, or API integrated systems.
2. Inspection Period & Deemed Acceptance
Upon delivery of goods, the Buyer is granted a 24-hour inspection window. Any discrepancies, damages, or issues must be reported to Florage Farms in writing within this timeframe. If no written notice is received within 24 hours of delivery, the goods are deemed accepted in their current condition, and the Buyer waives all rights to dispute the quality or quantity of the shipment.
3. Payment Authorization & Automatic Billing
The Buyer is required to maintain a valid credit card on file. By accepting delivery of goods, the Buyer explicitly authorizes Florage Farms to charge the card on file for the full invoice amount immediately following the expiration of the 24-hour inspection window.
4. Declined Payments & Late Fees
Payment velocity is a requirement of doing business with Florage Farms. In the event the card on file is declined or payment is not successfully processed within the 24-hour window:
- An immediate late fee of 1.5% of the total invoice or $100.00, whichever is greater, will be applied.
- An additional 1.5% interest charge will accrue every 7 days until the balance is cleared.
- The Buyer shall be responsible for all costs of collection, including but not limited to reasonable attorney fees and court costs.
5. All Sales Final
Due to the nature of our inventory and liquidation processes, all sales are final. Once the 24-hour inspection window has closed, no returns, exchanges, or refunds will be issued under any circumstances.
6. Shipping & Risk Of Loss
Risk of loss passes to the Buyer upon delivery to the carrier. Florage Farms is not responsible for delays, damages, or lost shipments once the product has left our facility. Any claims for transit damage must be filed by the Buyer directly with the shipping provider.
7. Limitation Of Liability
In no event shall Florage Farms be liable for any indirect, incidental, or consequential damages (including loss of profit or business interruption) arising out of the use or inability to use the products provided.
8. Governing Law
These terms are governed by the laws of Idaho. Any legal action or proceeding relating to these terms shall be instituted in the courts of Blackfoot, Bingham County, Idaho.
